Before Rahul Gandhi, there are other elected representatives have been disqualified under the Representation of the People Act
While the Congress and the opposition parties made quite a drama over the disqualification of Rahul Gandhi from Lok Sabha, he was not the first elected representative to be disqualified from Parliament or the assemblies.
Gandhi was disqualified following his conviction in a 2019 criminal defamation case filed against him for his comments against the Modi surname.
According to the Representation of the People Act, a person sentenced to imprisonment of two years or more shall be disqualified from the date of such conviction and remain disqualified for another six years after serving time.
Here is a list of elected representatives who have been disqualified from the Parliament or state assemblies under the Representation of the People Act following their conviction.
Lalu Prasad Prasad: Perhaps the most prominent name on the list, the former Union minister was disqualified from the Lok Sabha after his conviction in the fodder scam case in September 2013. The RJD supremo and former Bihar CM were then MPs from Saran in Bihar.
J Jayalalithaa: Another prominent name on the list, the late AIADMK supremo J Jayalalithaa had to lose her Chief minister’s chair following her disqualification in September 2014. She was sentenced to four years in jail in a disproportionate assets case.
Rasheed Masood: Rahul Gandhi was not the first Congress MP to be disqualified. It was then Rajya Sabha MP from Uttar Pradesh Rasheed Masood who became the first Congress leader to be disqualified. He was disqualified in 2013 after being convicted for four years in the MBBS seats scam case.
Jagdish Sharma: Like Lalu Prasad Yadav, Janata Dal (United) leader and then Lok Sabha MP from Bihar’s Jahanabad, Jagdish Sharma too was disqualified in 2013 after his conviction for four years in a Fodder scam case.
Enos Ekka: A Jharkhand Party MLA from Kolebira was disqualified in 2014 following his conviction for life imprisonment for the murder of a teacher named Manoj Kumar.
Kamal Kishore Bhagat: Another Jharkhand politician, Kamal Kishore Bhagat, was convicted in 2015 in an attempt to murder case. The MLA from Lohardaga was subsequently disqualified from the Jharkhand assembly.
Babanrao Gholap: The Shiv Sena MLA from Deolali in Maharashtra, Babanrao Gholap was convicted for three years in a disproportionate case in 2014 before being disqualified.
Suresh Halvankar: The Bharatiya Janata Party (BJP) MLA from Ichalkaranji in Maharashtra, was disqualified following his conviction in three years in a power theft case in May 2014.
Asha Rani: Only woman elected representative to face disqualification, BJP MLA from Madhya Pradesh’s Bijawar, Asha Rani was convicted for abetting the suicide of a maid in November 2013.
TM Selvaganapathy: Dravida Munnetra Kazhagam (DMK) Rajya Sabha MP from Tamil Nadu, TM Selvaganapathy resigned from his membership following his conviction for two years in a cremation shed case.
