AAP’s Delhi government said LG’s direct orders to officers were in violation of rules & a Supreme Court order.
The tug-of-war over the rule in Delhi escalated on Thursday after chief minister Arvind Kejriwal issued an order for government officers, asking them to “stop” taking direct orders from the Lieutenant Governor.
All ministers of the Aam Aadmi Party (AAP) led Delhi government have also directed secretaries of their departments to strictly comply with the transaction of business rules (TBR), sources said.
The move is the latest in the ongoing tussle between LG VK Saxena and CM Kejriwal regarding the administration of the national capital. AAP ministers have accused the LG, who is appointed by the Central government, of stalling the works of the elected government.
On Thursday, Deputy CM Manish Sisodia wrote to LG Saxena to send the file related to Delhi teachers’ training in Finland back to him. Sisodia said that the LG was sitting on the file for more than a month.
A war of words is also going on between CM Kejriwal and LG Saxena on Twitter over the issue of law and order for the past few days.
Sources said the secretaries in the departments have also been directed by the AAP government to report any direct orders received from the LG to the minister-in-charge.
LG Saxena has been issuing orders to department secretaries while bypassing the elected government in violation of Rules 49 and 50 of TBR and Supreme Court Judgement.
The government also directed the officers that implementation of such “illegal” direct orders from LG shall be considered a violation of Rule 57 of TBR.
Deputy CM Sisodia said that any such orders received directly from LG are in violation of the Constitution and directives of the Supreme Court.
Sisodia also said implementation of orders in violation of the top court’s directives and the Constitution will be viewed seriously by the government.
