Hero MotoCorp under lens over alleged court manipulation now

NEW DELHI – Prominent executives of Hero MotoCorp Ltd., including Executive Chairman Pawan Munjal and Non-Executive Director Pradeep Dinodia, have been served a legal notice by Brains Logistics Private Limited. The notice accuses them of engaging in illegal activities that allegedly obstructed legal proceedings.

 

The accusations revolve around “forum shopping” and manipulating court directions in an ongoing legal dispute. The issue stems from a case filed by Brains Logistics, in which the Magistrate’s Court ordered the Delhi police to register an FIR by July 22, 2024. The Karkardooma court had directed the police to file an FIR against Hero MotoCorp and its officials, including Munjal, in connection with the alleged cheating of Rs 64,95,000.

 

 

Hero MotoCorp responded by approaching the Delhi High Court, which later stayed the lower court’s order. However, Brains Logistics has alleged that Hero MotoCorp misguided both the High Court and the Delhi Police.

 

The legal notice claims that MotoCorp executives attempted to circumvent the court order by filing petitions before inappropriate benches of the Delhi High Court and manipulating the judicial process. It also alleges that deceptive emails were sent to the Delhi Police, falsely claiming that the High Court had stayed the FIR’s registration before any official court order was issued.

 

 

Brains Logistics has demanded an explanation within three days, failing which further legal action may be initiated. The notice states:

“At the instructions of you Noticee, dishonest tactics and misrepresentation were adopted … the registry/office was manipulated to list the said criminal case, without removing the ‘defects/objections raised by the registry’, thereby superseding and overreaching all the applicable High Court rules and practices.”

 

The notice further accuses the involved parties of committing an “offence under Section 217, 61 BNS,” resulting in “injury, harassment, and humiliation” of Brains Logistics Private Limited.

 

Hero MotoCorp’s Public Relations Officer was approached for a comment but was unavailable at the time of reporting.

This unfolding legal battle highlights the complexities and challenges within corporate legal disputes, especially involving high-profile executives and major corporations. The outcome of this case could have significant implications for corporate governance and legal accountability in India.
