Supreme Court reserves judgment on Arvind Kejriwal’s bail petition

NEW DELHI – The Supreme Court of India has reserved its judgment on the bail petition filed by Delhi Chief Minister Arvind Kejriwal, who is embroiled in the Delhi Excise Policy scam. The case, investigated by the Central Bureau of Investigation (CBI), has garnered significant public and media attention.

 

The hearing took place before a Bench comprising Justice Surya Kant and Justice Ujjal Bhuyan. After extensive arguments from both sides, the court decided to reserve its decision. The central issue in the case was whether Kejriwal should have sought bail from the trial court before approaching the Delhi High Court.

 

CBI’s counsel, Additional Solicitor General SV Raju, argued that Kejriwal bypassed the usual legal process by directly approaching the High Court. Raju emphasized that only in rare and exceptional cases can a bail plea be moved directly to the High Court, and the normal procedure would have been for the trial court to handle the matter first.

On the other hand, Senior Advocate Abhishek Manu Singhvi, representing Kejriwal, contended that the issues raised in the bail petition had already been argued and rejected by the trial court during remand. Singhvi argued that sending Kejriwal back to the trial court would be redundant and unfair, given the significant delay in hearing the case.

 

He also referenced the Manish Sisodia case, where the Supreme Court had noted that returning an individual to the trial court for bail would be akin to a “game of snakes and ladders.”

 

The Supreme Court is expected to deliver its judgment in the coming days, a decision that will be closely watched by political observers and the public alike.
