NEW DELHI: Animal rights activist and Bharatiya Janata Party’s member of Parliament Maneka Gandhi questioned Gurugram police’s alleged lack of action in filing a First Information Report against the controversial YouTuber Elvish Yadav, on Monday.
Saurav Gupta, a PFA activist, told The New Indian, “If Gurugram police don’t file an FIR, they will be compelled to move before the court under 156(3) CrPC to get an FIR lodged against Elvish Yadav.” Sub-Section 3 of Section 156 of the Code of Criminal Procedure states, “Any Magistrate empowered under section 190 may order such an investigation as above-mentioned.”
This complaint was filed days before the Noida Police filed an FIR in a snake venom peddling and snake smuggling case, naming Elvish as an accused.
The PFA has accused the Gurugram police of not taking the matter seriously, alleging that they are “trying to shelter the accused”. According to sources, the complaint was lodged against Elvish with the Gurugram Police on October 15, but the police did not take any action.

The New Indian accessed the complaint lodged with Gurugram Police against Elvish Yadav, Rahul Fazalpuria, and others for performing, publishing, and socialising with wild animals, including endangered species.
“The video shows that an endangered/banned wild animal species, i.e. snake, was used to perform in a video by the above-said accused persons for the purpose of entertainment and fame. These kinds of videos are spreading an unlawful, unjust, and illegal message across the people of the country,” read the complaint.
However, despite receiving the complaint, Gurugram Police didn’t take any action in the matter. Now, the PFA has planned to approach the court to get an FIR lodged against Elvish Yadav.
Moreover, the complaint also questioned the easy availability of the “endangered species” which could be seen in Elvish’s viral videos. “It is very astonishing that banned and endangered species were easily available to the above accused…means the accused is involved in trading/export/import of such endangered species and are in corroboration with animal smugglers and wildlife poachers.”
Presently, Elvish has been summoned for a third time, after skipping out on the second summon made by the Noida Police.
Earlier, when Elvish had emerged victorious as the Big Boss OTT winner as a wild card entry, he was felicitated by Haryana Chief Minister Manohar Lal Khattar as a youth icon amid a crowd of lakhs.
