A Delhi court is scheduled to hear Sisodia's bail application on Friday in the liquor policy case registered by the CBI.
Bharti, who is also a lawyer but doesn't represent Sisodia before the court, said CBI did not seek further custody for interrogation because they may have nothing to prove against him.
During the hearing, the CBI counsel told a special court that Sisodia was not cooperation with its probe into the liquor policy case.
