TADA Court Summons Rubaiya Sayeed

SRINAGAR: Rubaiya Sayeed, daughter of former Jammu and Kashmir chief minister Mufti Mohammad Sayeed, has been summoned by TADA Court on July 15 for recording her statement in a case related to her abduction in 1989 by the terror group Jammu and Kashmir Liberation Front.

Yasin Malik, who was given a life sentence in a terror funding case, is an accused in the case.

The directions to summon her came two days after a Delhi court awarded life imprisonment to Malik in a terror funding case. Special Judge Praveen Singh awarded varying jail terms to Malik for offences under the stringent anti-terror law – Unlawful Activities Prevention Act (UAPA) and the IPC, rejecting the NIA’s plea for capital punishment.

Rubaiya is one of the prosecution witnesses in the case involving Yasin Malik and nine others against whom the court had framed charges in January last year, more than 31 years after her abduction.

This is the first time that Rubaiya Sayeed has been asked to appear in the case. She had been freed after five terrorists were released in exchange.

Presently the case is at the evidence stage, with CBI counsel Monica Kohli presenting prosecution evidence against the accused persons before the court. The CBI chargesheet has said they borrowed a blue car from one of the accused, Ghulam Mohammad, and some of them assembled in the house of accused Mushtaq Ahmed Lone on December 8, 1989, and deliberated upon the plan to kidnap her when she is on her way back from the hospital to her residence at Nowgam Bye Pass, Srinagar.

While Yasin Malik, Ali Mohammad, Gandroo, Sofi, Sheikh and Pahloo have committed the offences of entering into a criminal conspiracy, kidnapping Rubaiya with an intention to murder and keeping her in wrongful confinement under provisions of the Indian Penal Code, apart from Terrorists and Disruptive Activities (TADA) Act and Indian Arms Act, Mohammad Zaman, Javed Ahmed, Bashir and Bakshi have been charged with criminal conspiracy, keeping Rubaiya under wrongful confinement and provisions of the TADA Act.

These 10 accused are among the two-dozen accused named by the CBI in its chargesheet filed before the TADA court. Among the others, Mohammad Rafiq Dar and Mushtaq Ahmed Lone are dead and 12 others are absconding.

The absconders include Halima, Javed Iqbal Mir, Mohammad Yaqub Pandit, Riyaz Ahmed Bhat, Khursheed Ahmed Dar, Basharat Rehman Noori, Tariq Ashraf, Shafat Ahmed Shangloo, Manzoor Ahmed, Gulam Mohammad Taploo, Abdul Majeed Bhat and Nissar Ahmed Bhat.

According to the CBI chargesheet, in the first week of December 1989, the accused entered into a criminal conspiracy to kidnap Rubaiya, then undergoing resident rotatory internship training in Lal Ded Hospital at Srinagar, for ensuring the release of their five associates lodged in different jails.
