Supreme Court questions Bibhav Kumar’s bail request

New Delhi: In a significant development, the Supreme Court has expressed serious concerns about Bibhav Kumar, the Personal Secretary to Delhi Chief Minister Arvind Kejriwal, in connection with his alleged assault on AAP Rajya Sabha MP Swati Maliwal.

On Thursday, a Bench of Justices Surya Kant, Dipankar Datta, and Ujjal Bhuyan criticized Kumar, questioning his apparent lack of remorse regarding the incident. The Court remarked that while it frequently grants bail to individuals accused of severe crimes such as murder, it was particularly troubled by the details in the FIR, which described Maliwal’s distressing physical condition.

The Bench emphasized their concern that Kumar’s influential status could potentially lead to witness tampering. “We grant bail to murderers and killers, but look at the FIR—she is crying over her physical condition. If someone like him cannot influence witnesses, who else could? He doesn’t seem to feel any shame,” the Court observed.

Senior Advocate Abhishek Manu Singhvi, representing Kumar, criticized the Court for treating the FIR as a definitive account and pointed out that his client’s complaint was ignored by both the friendly Lieutenant Governor and the police, who only registered Maliwal’s complaint.

The Supreme Court has issued a notice on Kumar’s bail plea and has scheduled the matter for next Wednesday. Kumar, who was arrested on May 18, has had his bail applications rejected by both the lower court and the Delhi High Court. The police have filed a chargesheet in the case, which the Supreme Court plans to review.

The matter has been listed for further proceedings next Wednesday, and the Court has directed that the chargesheet be submitted on that date.
