Shah Faesal and Shehla Rashid withdraw petition challenging Article 370 abrogation

The Supreme Court’s five-judge Constitution bench, led by Chief Justice DY Chandrachud, granted their request and removed their names from the list of petitioners.

NEW DELHI: Bureaucrat Shah Faesal and ex-student leader Shehla Rashid Shora have recently made headlines as they withdrew their petitions challenging the scrapping of Article 370 in Jammu and Kashmir. The Supreme Court’s five-judge Constitution bench, led by Chief Justice DY Chandrachud, granted their request and removed their names from the list of petitioners.

Shah Faesal, who gained attention in 2009 for topping the civil services exam, made a significant impact when he resigned from his bureaucratic position in 2019. He cited the “unabated killings in Kashmir” and the alleged marginalization of Indian Muslims by the central government as his reasons for protest. Taking to social media, he accused the government of undermining public institutions. Following his resignation, Faesal founded the Jammu & Kashmir Peoples’ Movement, a political party aimed at addressing the concerns of the region. He was reinstated by Central Government in August, 2022.

Shehla Rashid, known for her role as the vice-president of the students’ union at Jawaharlal Nehru University (JNU), rose to prominence during the agitation demanding the release of student leaders, including Kanhaiya Kumar and Umar Khalid, who faced charges of sedition in 2016. Shehla Rashid later joined Shah Faesal’s party, sharing a common goal of advocating for the rights and aspirations of the people of Jammu and Kashmir.

The withdrawal of their petitions challenging the abrogation of Article 370 signifies a significant shift in their stance on the matter. Shah Faesal was among the leaders from Kashmir who were detained after the central government revoked the special status granted to Jammu and Kashmir, reorganizing it into two Union Territories. However, in August 2020, the Jammu & Kashmir Peoples’ Movement announced Faesal’s relief as a party member upon his request. Shehla Rashid also parted ways with the party.

It is worth noting that Rashid and Faesal were among the 23 petitioners who had moved the Supreme Court in 2022, challenging the Union government’s decision to abrogate Article 370 and downgrade Jammu and Kashmir into two Union Territories. The apex court’s Constitution Bench, headed by Chief Justice DY Chandrachud, had set the hearing of pleas against the abrogation to commence on August 2. The hearing is expected to proceed on a daily basis.
