New Delhi: A Delhi Court released the SUV driver on bail, on Thursday, arrested in connection with the Rajendra Nagar incident, where three students drowned.
“The prosecution has stated in its written reply that they don’t have enough material against Kathuria. The case of culpable homicide under Section 105 of BNS (culpable homicide) does not stand against him. The rest of the sections under which Kathuria has been made an accused are all bailable,” the court noted while granting him bail.

Manuj Kathuria, the SUV driver, was accused of driving rashly and negligently, causing rainwater to splash onto the iron gate of Rau’s Academy, which then broke and led to a flood-like situation in the building’s basement.
Today, Kathuria moved a bail application and was granted bail by the court. “The police, in overenthusiasm, accused him of culpable homicide,” the court remarked.

On Wednesday, a magisterial court had denied Kathuria bail. He subsequently moved the application before a Sessions Court. The magisterial court noted that an onlooker had warned Kathuria not to drive past, but he did so anyway.
Kathuria’s lawyers argued that the police lacked evidence to support their case against him. The prosecution admitted they did not have enough material against Kathuria, leading to the charges being dropped.
