NEW DELHI: The Punjab and Haryana High Court has nullified the First Information Report (FIR) lodged against real estate firms Emaar India and Jones Lang LaSalle Property Consultants (JLL).

The complaint, initially filed by MGF Developments, accused the two companies of financial misconduct amounting to Rs 1,000 crore.

The courtโ€™s ruling came after a meticulous examination of the caseโ€™s fundamental aspects. It noted that the complainant had withheld crucial information and that the accusations were primarily of a civil nature.

This was further corroborated by the existence of ongoing arbitration proceedings at the International Chamber of Commerce. The court also observed that the complaint did not disclose any legally recognizable criminal offense, raising concerns about the Metropolitan Magistrateโ€™s preliminary order.

Taking all these aspects into account, the High Court proceeded to dismiss the case.

In its verdict, the court stated, โ€œUpon reviewing the allegations made in the complaint, it is evident that they do not fulfill the criteria for criminal offenses as claimed. Additionally, it is clear that the complaint constitutes an abuse of legal procedures, warranting the invocation of jurisdiction under Section 482 of the Criminal Procedure Code. The complaint lacks elements of a cognizable offense, and therefore, the Magistrateโ€™s order is overturned. As a result, the FIR registered against the petitioners is hereby annulled.โ€

The original FIR was lodged at Sector 29 Police Station, citing various sections of the Indian Penal Code, including those related to criminal breach of trust, cheating, and forgery.
