MCD issues notice to Drishti Coaching Centre for misuse of property

MCD has issued a notice regarding the misuse of property by the Drishti Coaching Centre owned by Vikas Divyakirti. The coaching centre is located in the basement of the Single Unit Local Shopping Centre, Vardhman Mall, Nehru Vihar, Delhi-110054. The property in question includes the combined basement of Towers 1, 2, and 3. This use is reported to violate Clause 15.9 of the Master Plan for Delhi 2021 (MPD-2021).

NEW DELHI: The Municipal Corporation of Delhi (MCD) has issued a notice regarding the misuse of property by the Drishti Coaching Centre owned by Vikas Divyakirti. The coaching centre is located in the basement of the Single Unit Local Shopping Centre, Vardhman Mall, Nehru Vihar, Delhi-110054. The property in question includes the combined basement of Towers 1, 2, and 3. This use is reported to violate Clause 15.9 of the Master Plan for Delhi 2021 (MPD-2021).

A show cause notice dated 22 July 2024 was issued to M/s. Dristi (The Vision), but no response was received within the stipulated period. Additionally, it was observed that the property does not conform to the occupancy details specified in the occupancy certificate dated 12 April 2010. The certificate, issued during a survey by field staff, indicated that the premises should not be used for commercial activities, but a coaching centre has been operating in violation of these conditions.

In related legal matters, the Delhi High Court clarified on 10 May 2024 that Rule 27 (4) of DFS Rules 2010 applies to buildings, including basements, with a height of more than 15 meters, requiring a valid Fire NOC (No Objection Certificate). It has been brought to attention that the basement at Vardhman Mall has not complied with this requirement, as mandated by the Delhi High Court.

The Deputy Commissioner of Civil Lines Zone, Kumar, has reviewed the situation and determined that the misuse of the premises is a serious violation. Consequently, he has ordered the sealing of the premises/shop/establishment to prevent further misuse. The order mandates immediate compliance by the concerned authorities, including the Officer/Assistant Engineer (Building) of the Civil Lines Zone.

The MCD has been directed to enforce this decision promptly, ensuring that the premises are sealed by the regulations and statutory requirements set forth under MPD-2021. The Deputy Commissioner has emphasized the importance of adhering to these legal and regulatory standards to avoid future discrepancies and violations.
