NEW DELHI: Maneka Gandhi’s animal welfare NGO, People for Animal (PFA), has approached the Gurugram Court seeking the filing of an FIR against YouTuber Elvish Yadav and Haryanvi singer Rahul Fazalpuria for their alleged use of snakes and endangered species in their videos.

Although a complaint was lodged with the Gurugram Police, as of now, no FIR has been registered.

The court is scheduled to hear the complaint on Monday morning and is expected to request a Status Report from the Haryana Police. Saurabh Gupta, an animal rights activist, filed the plea on behalf of the NGO PFA.

“I (Saurabh Gupta) came across a video in which endangered species were used by Elvish Yadav. I lodged a complaint with Haryana Police on 15/10/2023. When no action was taken, I met the Haryana Police commissioner on 6/11/2023. Failing to prompt any action, I am compelled to approach the court,” read the petition accessed exclusively by The New Indian.

Gupta emphasised that the petition was filed under section 156(3) CrPC after the Gurugram Police did not register an FIR based on their complaint.

“We are seeking legal action against Elvish and Fazalpuria under sections 9, 39, 49, 50, and 51 of the Wildlife Protection Act, section 11 A of the Prevention of Cruelty to Animals Act, relevant provisions of the Performing Animals Rules, and relevant provisions of the Public Gambling Act,” said Gupta.

Animal rights activist Maneka Gandhi recently engaged with Gurugram Police Commissioner Vikas Kumar Arora regarding PFA’s complaint against Yadav and Fazalpuria. She urged legal action and expressed concern over the absence of an FIR despite the NGO’s complaint.

Speaking with The New Indian, Gupta mentioned that the plea was submitted and accepted by the court and on Monday arguments will be heard on it.

The New Indian had also accessed the complaint lodged with Gurugram Police against Elvish Yadav, Rahul Fazalpuria, and others for performing, publishing, and socialising with wild animals, including endangered species.

“The video displays the use of an endangered/banned wild animal species, ‘Le snake,’ by the accused individuals for entertainment and fame. Such videos propagate an unlawful, unjust, and illegal message among the people of the country,” read the complaint.

PFA has now turned to the court to urge the filing of an FIR against Elvish Yadav and Rahul Fazalpuria. Recently, the Noida Police filed an FIR in connection with a Snake-Venom case, where Elvish Yadav’s name was mentioned. He was interrogated by the Noida Police for three hours concerning this matter.
