GURUGRAM: A Gurugram court asked the police to file an Action Taken Report in connection with a plea filed to get an FIR filed against YouTuber Elvish Yadav, on Tuesday.
Bharatiya Janata Party’s Maneka Gandhi’s NGO, People for Animals, had filed the plea before the court to get an FIR filed against Elvish and Haryanvi singer Rahul Fazalpuria for the alleged smuggling and using snakes, and other endangered species in their videos.
Presently, the court has asked the Gurugram Police to file an ATR by December 2.
Jugal Kishore Gupta, the advocate appearing for the PFA, told The New Indian that since the concerned magistrate was on leave, the matter was referred to the link magistrate who directed the police to file an ATR.
“Complaint presented today. It is checked and registered. Now, to come upon December 2 for filing of Action Taken Report. Let, notice be issued to the concerned Investigation Official (IO) regarding same for the date fixed. File be sent to the concerned Court immediately,” the court noted in its order.

A complaint was recently lodged by the PFA to the Gurugram Police against Elvish Yadav, but no FIR has been lodged as of now.
Animal rights activist, Saurabh Gupta, had then moved a plea on behalf of Gandhi’s PFA before the Gurugram court.
“We seek legal action against Elvish and Fazalpuria under sections 9, 39, 49, 50, and 51 of the Wildlife Protection Act, section 11 A of the Prevention of Cruelty to Animals Act, relevant provisions of the Performing Animals Rules, and relevant provisions of the Public Gambling Act,” Gupta said.
Gupta mentioned that the petition was filed under section 156(3) CrPC after the Gurugram Police did not register an FIR based on their complaint.
The BJP MP and animal rights activist had recently communicated with the commissioner of the Gurugram Police, Vikas Kumar Arora, urging him to take legal action,w expressing concern over the lack of an FIR despite the NGO’s complaint.
“I (Saurabh Gupta) had come across a video in which endangered species were used by Elvish Yadav. I lodged a complaint with the Haryana Police on 15/1-02023. When no action was taken, I met the Gurugram police commissioner on November 6. Failing to take any action, I am compelled to approach the court,” read the petition accessed by The New Indian.
The New Indian had also accessed the complaint lodged with Gurugram Police against Elvish Yadav, Rahul Fazalpuria, and others for performing, publishing, and socialising with wild animals, including endangered species.
PFA has now turned to the court to seek the lodging of an FIR against Elvish Yadav and Rahul Fazalpuria. Recently, the Noida Police filed an FIR in connection with a snake venom case. He was questioned for three hours by the Noida Police regarding this matter.
