Delhi LG Gives Sanction To Prosecute AAP MLA By CBI

NEW DELHI: Delhi Lieutenant Governor Vinai Kumar Saxena has granted the sanction to prosecute Aam Aadmi Party (AAP) MLA Amanatullah Khan in a case related to recruitments in Delhi Waqf Board. The Central Bureau of Investigations (CBI) registered a case against him in 2016.

Waqf Board is a unit that looks after matters related to the Muslim properties used for religious or charitable purposes.

Sources said LG has granted sanctions to prosecute Khan, along with his associate Mehboob Aalam, for the commission of criminal offences that include deliberate and criminal violation of rules, regulations and law and misuse of position and causing financial losses to the exchequer while serving as Chairman and CEO of the Delhi Waqf Board respectively.

The sanction has been granted under section 19 of the Prevention of Corruption Act, 1988 and Section 197 of the Code of Criminal Procedure, 1973, said sources.

AAP MLA from Okhla was booked by the CBI for the scam in November 2016. Allegations are that he illegally appointed many people on the board, who were his relatives or friends. Soon after that, he resigned from the post of its chairman.

Sources said the CBI, in its investigations, revealed sufficient prosecutable evidence of the commission of criminal offences and had sought prosecution sanction of LG in May 2022.

Sources said, as per the investigation of the CBI, Khan, in connivance with Aalam, abused his official position and deliberately ignored rules and laid down procedures to cause huge losses to the government exchequer by arbitrarily appointing individuals by manipulating recruitment procedures to favour chosen individuals over thousands of deserving people.

The basic principle of the right to equality and opportunity was bypassed by Khan to provide undeserving and unauthorized benefits to specific pre-identified persons.

After carefully going through the records placed on file, that prima facie provide sufficient evidence of culpability of Khan and Mehboob Aalam and warrant the grant of prosecution sanction for launching criminal proceedings against them, the LG has accorded such sanction, said sources from the LG office.
