Delhi Court rejects coaching centre CEO’s plea for access to premises

NEW DELHI — In a recent ruling, a Delhi court has upheld its decision to deny Abhishek Gupta, CEO of Rau’s IAS Study Circle, access to the coaching centre’s premises in Old Rajendra Nagar. The court cited safety concerns and insufficient grounds for granting permission to enter the upper floors of the building.

 

The tragic incident in July, where three IAS aspirants drowned in the basement, prompted the court’s scrutiny. Despite a show-cause notice from the Municipal Corporation of Delhi (MCD), the premises continued to be misused, with no action taken to halt the illegal use of the basement.

 

Kishore Singh Kushwaha, a student, had filed a complaint on June 26, 2024, which went unanswered. Gupta’s application sought access to the premises, excluding the basement, claiming that the entire building was unnecessarily barricaded. He argued that this restriction adversely affected students’ ability to attend offline classes, impacting their education.

However, the court maintained its stance, emphasizing that the petition’s basis—students’ hindered studies due to non-access—did not outweigh safety concerns. Despite 121 emails from students and parents supporting Gupta’s plea, the court prioritized safety and denied permission.

 

This decision underscores the importance of balancing educational needs with safety protocols, especially in shared spaces. As the legal battle continues, stakeholders await further developments in this case.
