KOLKATA: Chief Justice of India DY Chandrachud has slated to take his decision regarding Trinamool Congress leader Mahua Moitra’s ouster from the Lok Sabha, on Wednesday.
Justice SK Kaul informed Moitra’s advocate Abhishek Manu Singhvi of the case being placed in front of CJI Chandrachud, who will be taking the final call. According to sources, Singhvi had approached the Supreme Court to suggest they take up the case on either Thursday or Friday.
However, the CJI directed the senior advocate to convey the message to him over mail, following which he would look into it. Earlier, Moitra had mentioned her plea in front of Justice SK Kaul, since CJI Chandrachud was sitting on a Constitution bench. However, following the listing, Justice Kaul suggested Singhvi mention the case in front of the CJI.

The expelled parliamentarian from the Trinamool Congress (TMC) Mahua Moitra moved the Supreme Court to challenge her expulsion from the Lok Sabha on Monday, following her ouster.
The Krishnanagar MP was expelled upon the recommendation of the Parliamentary ethics committee in the cash-for-query scandal, on December 8, when the lower house passed a resolution to expel Moitra in accordance with the report.
According to sources, Moitra has questioned the process of investigation that led to her expulsion, submitting a 15-page application to the SC. Speculations had already been rife regarding her SC move following the happenings at the Lok Sabha.

In the report, Moitra allegedly mentioned how she was harassed by being asked personal questions when she was summoned during the course of the interrogation. Moitra has allegedly accused the ethics committee of bypassing protocol, according to the sources.
Bharatiya Janata Party’s (BJP) member of parliament, Nishikant Dubey, had initially raised apprehensions regarding Moitra, while accusing her of receiving expensive gifts and sharing her login credentials with industrialist Darshan Hiranandani, to submit questions against Gautam Adani’s conglomerate.
Calling the act “unfortunate for a democracy,” West Bengal Chief Minister Mamata Banerjee condemned Moitra’s ouster from the parliament, stating that she is a victim of “vendetta politics”. “I am telling you that Mahua is a victim of the circumstances and I strongly condemn it. Our party is totally behind Mahua. Our party will fight along with the INDIA alliance together,” Banerjee told the media.
Moitra’s expulsion has marked the first instance of a parliamentarian being ousted from the new parliament building’s premises.
