BJP urges ECI to suspend Rahul Gandhi’s X account over Rajasthan poll violations

NEW DELHI: As Rajasthan heads to the polls for the 2023 Assembly Elections, the Bharatiya Janata Party (BJP) has lodged a complaint with the Election Commission of India (ECI), seeking the suspension of Congress MP Rahul Gandhi’s social media account, X. The BJP alleges violations of the Representation of People Act 1951 in a post by Rahul Gandhi on the day of the elections.

Taking to X, Rahul Gandhi had posted, “Rajasthan will choose free treatment. Rajasthan will choose cheaper gas cylinders. Rajasthan will choose interest-free agricultural loan. Rajasthan will choose English education. Rajasthan will choose OPS. Rajasthan will choose caste census. Today, go out in large numbers and exercise your franchise. Elect a Congress government that is beneficial to the people and has guarantees.”

In the complaint addressed to the ECI by BJP leader Om Pathak, the saffron party contended that Rahul Gandhi, despite the conclusion of the election campaign, took to X to promote Congress’ promises in Rajasthan. The party deemed this act a significant breach of electoral laws and the Model Code of Conduct.

The BJP’s letter accused Rahul Gandhi of violating the 48-hour silence zone, which prohibits election-related activities within 48 hours of polling. The party argued that posting such a message on the day of the polls constitutes an offense under Section 126 of the Representation of People Act 1951.

Section 126 of the RPA 1951 prohibits public meetings, displaying election material, or propagating election matters through various means during the 48 hours leading up to the conclusion of the polls.

The BJP’s letter to the ECI expresses concern about a pattern of flouting laws and MCC (Model Code of Conduct) by Rahul Gandhi and requests swift and stern punitive action to maintain the integrity of free and fair elections.

Additionally, the BJP urged the ECI to issue directions to the Chief Election Officer of Rajasthan to file a criminal complaint and initiate criminal prosecution against Rahul Gandhi. The letter underscored the need to curb any further violations of the 48-hour silence zone, ensuring a fair electoral process.
