NEW DELHI: Seven Bharatiya Janata Party (BJP) legislators from the Delhi Assembly have moved the Delhi High Court, questioning the prolonged delay by the Aam Aadmi Party (AAP)-led Delhi government in tabling 14 Comptroller and Auditor General (CAG) reports in the Assembly. According to the petition, the reports have been delayed by approximately 490 days.
During Monday’s hearing, the Court reprimanded the Delhi government for the significant delay. Justice Sachin Datta, who presided over the matter, sought clarity on certain legislative procedures, such as the concept of prorogation, the timing of the last prorogued session of the Delhi Assembly, and the distinction between prorogation and dissolution of the legislative assembly.

The petition, filed by BJP MLAs Vijender Gupta, Mohan Singh Bisht, Om Prakash Sharma, Ajay Kumar Mahawar, Abhay Verma, Anil Bajpai, and Jitender Mahajan, called for the CAG reports to be submitted to the Assembly Speaker and requested a special session of the Assembly to deliberate on these reports. Advocates Neeraj and Satya Ranjan Swain represented the petitioners, while Senior Advocate Mahesh Jethmalani emphasized that tabling CAG reports is a constitutional mandate under Articles 149 and 151

Previously, the High Court had addressed a similar petition, which had been closed after the Delhi government assured the tabling of the reports by mid-December. However, with the reports still pending, the BJP MLAs returned to the Court.

Senior Advocate Rahul Mehra, representing the Delhi government, stated that Chief Minister Atishi had written to the Assembly Secretary in December, seeking a suitable date to table one report—“Performance Audit Report on Children in Need of Care and Protection”—with others to follow. However, the Lieutenant Governor’s (LG) office alleged continued delays by the AAP government, describing them as “delay tactics.”
The Assembly Secretary argued that these reports are tabled primarily for detailed scrutiny by the Assembly and the Public Accounts Committee (PAC), not for public dissemination. The Delhi government further noted that the PAC traditionally reviews such reports formed after elections.
