J&K govt to seize assets of banned outfits

SRINAGAR: The Centre on Thursday directed the Jammu and Kashmir administration to seize all assets and freeze bank accounts and finances belonging to the pro-Pakistani separatist amalgam Tehreek-e-Hurriyat and Muslim League Jammu Kashmir headed by a terrorist turned separatist Masarat Alam. Both organisations were recently banned by the government.

The Ministry, in a notification, said, “In the exercise of the powers conferred by Section 42 of the UAPA, the Central Government hereby directs that all powers exercisable by it under Section 7 and Section 8 of the said Act shall be exercised also by the State governments and the Union Territory administration about the two unlawful associations”.

While Section 7 of the UAPA pertains to the “power to prohibit the use of funds of an unlawful association”, Section 8 gives the “power to notify places used for an unlawful association”. The Ministry’s notification on December 31 said the TeH is known for its involvement in fomenting terrorism and anti-India propaganda for fuelling the secessionist activities in Jammu and Kashmir and that the leaders and members of the outfit have been involved in raising funds through various sources, including Pakistan and its proxy organisations for perpetrating unlawful activities, including supporting terrorist activities, sustained stone-pelting on security forces in Jammu and Kashmir.

The December 27 notification banning the MLJK-MA said that the outfit is known for its anti-India and pro-Pakistan propaganda and its objectives are to get the freedom of J&K from India to realise the merger of J&K with Pakistan and establish Islamic rule. J&K Government sources told The New Indian, “No property has been found in the names of Tehreek Hurriyat Kashmir (THK) founded by Syed Ali Shah Geelani who died in 2021, Jammu and Kashmir Democratic Freedom Party (JKDPF) floated by jailed secessionist Shabir Ahmad Shah and Muslim League headed by jailed terrorist-turned secessionist Masrat Alam Bhat.

However, as per J&K Government sources, “During the year 2003-2004, there had been a dispute over a residential property at Hyderpora between Syed Ali Shah Geelani and Jamaat Islami.” J&K Government sources told TNI“Jamat-e-Islami had claimed the residential property where Syed Ali Shah Geelani (Founder Tehreek Hurriyat) was residing its property which as per reports was opposed to by Syed Ali Shah Geelani and put forth some documents justifying that the house occupied by him is not the property of any other organisation”.

On 20th December 2022 District Magistrate, Srinagar ordered the sealing of a storey residential structure constructed over proprietary land measuring 17 marlas and 199 sqft. Survey No. 1388/307 at Barzulla, Srinagar registered in the name of Syed Ali Shah Geelani and Firdous Ahmad Asmi S/o Ghulam Nabi Asmi vide mutation No. 2646. The order pertains to a case registered by the State Investigation Wing (SIA) of Jammu and Kashmir Police.

The Enforcement Directorate (ED) has already provisionally attached the house of Shabir Ahmad Shah (Chairman Democratic Freedom Party) in the Sanat Nagar area of Srinagar under the Prevention of Money Laundering Act 2002. ‘
